Herbalife Appoints Wynne Roberts as Senior Vice President of Herbalife Europe

-Herbalife Ltd. (NYSE:HLF) announced today the appointment of Wynne Roberts as senior vice president of Herbalife Europe with responsibility for all strategic and operational functions for the company's Europe, Middle East and Africa (EMEA) region, effective October 17, 2005.

Roberts, who will report to Herbalife President and Chief Operating Officer Greg Probert, replaces Brian Kane, who retired recently after twelve years with the company. Roberts will be based in the company's European headquarters in Uxbridge, England.

"MAJOR door-to-door sales companies are stepping up efforts to expand their presence across China in preparation for new direct selling regulations that come into effect in two months.

Herbalife International, one of the five biggest direct selling enterprises in the United States — Avon, Amway, Marykay and Nuskin are the others — will open 30 stores by the end of this year.

Although the new regulations said companies don't have to open retail stores to enter the market, it does require companies to set up service outlets in areas where the company conducts door-to-door sales. The outlets are to cater to customers and provide refund or exchange services.

USANA Acquires Manufacturing Facility in China

USANA Health Sciences Inc. (NASDAQ: USNA) today announced that it has purchased for cash a personal care manufacturing facility in China. The experienced local management team will remain in place and the facility features expansion capability. The terms of the transaction were not disclosed.

"This marks a significant first step for our long-term plan of developing the Chinese market," said USANA President Dave Wentz. "The recent release of the new regulations that will govern direct selling in China allows us to actively prepare for entry into one of the world's largest direct selling markets."

The regulations indicate that the new direct selling laws will go into effect on Dec. 1, 2005. USANA's timeline for receiving a direct selling license and obtaining product approvals is uncertain, but could take as long as 12 months.

Direct sales in China will become legal from Dec 1, the Information Times reported, citing Shang Ming, a senior official with the Ministry of Commerce.

The newspaper said the new law, just approved by China's State Council, the country's cabinet, requires direct sellers to pay a minimum 20 mln yuan deposit before setting up business and to have a registered capital of at least 80 mln yuan.

Maximum commissions for individuals engaged in direct sales will be 30 pct, up from 25 pct previously before direct sales were banned in 1998.

The newspaper said the new law has tightened some requirements for companies which apply for direct sales licenses, including not having incidences of irregularities over the past five years.

It quoted an unidentified industry source as saying about 25 domestic and foreign companies are currently eligible to apply for direct sales licenses.

The first batch of direct sellers to be granted licenses are expected to start operations in China at the beginning of next year, said the newspaper.

It said the State Council has also approved legislation which would shut down illegal pyramid sales, which will take effect on Nov 1.

China banned direct sales in 1998 due to widespread problems with pyramid schemes and other fraudulent activities, forcing firms like Avon to sell through retail outlets.

Companies engaged in direct sales have long been anticipating approval of the new law, with foreign direct sellers already opening new stores in China.

Amway's outlets in China have now topped 160, with Nu Skin operating over 150 stores across the country.
